District Court of Jamnagar

Jamnagar, the royal city, was once known as Navanagar. It is said to have been founded by Jam Rawal Jadeja sometime around 1540 AD. Jamnagar city forms part of Jamnagar district located in the southern Gulf of Kutch in Gujarat. The district comprises of administrative panchayats of Jam Jodhpur, Dhrol, Jamnagar, Jodiya,  Kalavad and Lalpur. The population of the district is about 2200,000 and justice is dispensed through District Courts of Jamnagar.

The Jams of Jamnagar dispensed justice and the earliest court was set up in 1864 near Khambhalia Darwaja, shifted later on to Darbargarh overseeing taluka courts. After independence the Government of India established a judiciary system and the present day district court of Jamnagar is located in Lal Bungalow. A new civil court building was set up and today civil courts function from these premises. The district courts of Jamnagar include the taluka courts of Jam Jodhpur, Kalavad, Lalpur, Jodiya and Dhrol.

The Indian judicial system follows the British system and justice is dispensed through courts within a defined framework of laws as laid down by the Indian Constitution. The Constitution was defined in 1950 and framed the Indian judicial system, defining powers of judges and officials at all levels. Under this system courts dispense justice in relation to State Laws and Union Laws. The Supreme Court sits at the top, followed by High Courts of each State that in turn administer district courts in each district within its jurisdiction.  The Indian judicial system follows the common law system along with regulatory law and statutory law, making for a maze of legal complications.

The district court of Jamnagar is presided over by a judge to dispense justice at a district level while taluka courts handle cases within their jurisdiction, all of them functioning under the control of the High Court of Gujarat. The highest level in the district court is that of the district and sessions judge. In addition there is the Sessions court that handles a variety of cases including criminal cases.

Rankings in the Court:
In the district courts there are civil and criminal courts. The courts are ranked from high to low according to the type of cases handled. There is a principal court of the civil judge, senior division, to handle civil cases of any valuation while the middle and lower section handle cases of appropriate value. The Chief Judicial Magistrate presides over criminal courts, again categorized into three levels from low to high according to severity of the case. Regardless of the level, courts have equal jurisdiction. As for the Sessions Court, the judge has the same powers as the District Judge.  District courts of Jamnagar operate independently and decide cases on merits of law.

It is a well known fact that the judiciary system is overtaxed with a huge backlog of cases. The situation is no different in the case of district courts of Jamnagar and people have to put up with inordinate delays. This is a way of life and is considered routine. Despite this backlog, the courts have regular holidays and extended vacations.
